Terms of Service

1. Agreement to Terms

By accessing or using AestheticIQ ("the Service") at aestheticiq.ai or app.aestheticiq.ai, you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

AestheticIQ is a business intelligence platform that connects to your Aesthetic Record account to retrieve and display aggregated revenue, appointment, and practitioner performance metrics. The Service is intended for use by medical spa owners, operators, and their authorized staff.

3. Account Registration

To use the Service, you must create an account. You agree to:

• Provide accurate, complete, and current information
• Maintain the security of your login credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activity that occurs under your account

One account may represent multiple practice locations under a single subscription. You may invite team members under the access tiers defined in your subscription plan.

4. Aesthetic Record Credentials

By providing your Aesthetic Record login credentials, you represent that you are authorized to grant AestheticIQ access to retrieve data from that account. You are responsible for ensuring that your use of AestheticIQ to access Aesthetic Record complies with Aesthetic Record's own terms of service. AestheticIQ encrypts your credentials with AES-256-GCM and uses them solely to perform scheduled data syncs on your behalf.

5. Subscription and Billing

5.1 Plans and Pricing

AestheticIQ offers subscription plans as described on our Pricing page. Prices are listed in USD and billed monthly or annually as selected at signup.

5.2 Free Trial

We offer a 14-day free trial for new accounts. No credit card is required to start a trial. At the end of the trial period, continued use requires a paid subscription.

5.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. We do not provide refunds for unused portions of a billing period.

5.4 Price Changes

We reserve the right to modify pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to other accounts or systems
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated tools to scrape or extract data from the Service in bulk
• Resell or sublicense access to the Service without written permission
• Use the Service in a way that interferes with its normal operation or availability
• Transmit malware, viruses, or malicious code

7. Intellectual Property

The Service and its original content, features, and functionality are owned by AestheticIQ and are protected by intellectual property laws. You retain ownership of the business data retrieved from your Aesthetic Record account. You grant AestheticIQ a limited license to process that data for the sole purpose of providing the Service to you.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms. We process your data only as described in the Privacy Policy.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We perform routine maintenance and may experience downtime due to factors outside our control, including changes to the Aesthetic Record platform. We will communicate planned maintenance in advance where possible.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT DATA SYNCED FROM AESTHETIC RECORD WILL BE COMPLETE, ACCURATE, OR CURRENT AT ALL TIMES.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AESTHETICIQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We reserve the right to suspend or terminate your account for violation of these Terms, fraudulent activity, or non-payment, with notice where practicable. Upon termination, your right to use the Service ceases immediately. Sections 7, 10, 11, and 13 survive termination.

13. Governing Law

These Terms are governed by the laws of the State of Missouri, United States, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of Missouri.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email and posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
